These terms apply to all purchases made through this website operated by Pool Robots ("we", "us"). By placing an order you agree to these terms. Nothing in these terms limits your rights under New Zealand consumer law — in particular the Consumer Guarantees Act 1993 (CGA) and the Fair Trading Act 1986 (FTA).
1. Orders and acceptance
An order submitted through this website is an offer to purchase. A contract forms when we confirm the order (usually by order confirmation email).
We may decline or cancel an order (in whole or part) if a product is unavailable, mispriced, or the order appears fraudulent. If we cancel a paid order we will refund you in full.
2. Pricing and payment
All prices are in New Zealand dollars (NZD) and include GST unless stated otherwise.
We take reasonable care to ensure pricing accuracy. Where a genuine pricing error occurs, we may cancel the affected order and refund any payment made.
Payment is required before dispatch unless we have agreed to account terms in writing.
3. Delivery
Estimated delivery times are indicative only and are not guaranteed. See our Shipping page for current timeframes and freight charges.
Risk of loss or damage passes to you on delivery to the address provided. Title passes on receipt of full payment.
Please inspect your delivery on arrival and report damage or shortages to us within a reasonable period (7 days) so we can resolve the issue.
4. Consumer guarantees
Goods supplied to consumers come with guarantees under the Consumer Guarantees Act 1993 that they are of acceptable quality, fit for purpose, and match their description.
Where a CGA guarantee is not met, you are entitled to a remedy — repair, replacement or refund as set out in our Refund & Returns Policy.
The CGA applies to goods bought for personal, domestic or household use. Where goods are acquired for business purposes, the CGA may not apply, and our liability is limited as permitted by law.
5. Fair trading
Our product descriptions, images and marketing are prepared in accordance with the Fair Trading Act 1986. We do not make misleading or deceptive representations.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the CGA or FTA that cannot lawfully be excluded.
6. Liability
To the extent permitted by law, our liability for any claim relating to goods or services is limited to the purchase price paid, or the remedy required under the CGA, whichever applies.
We are not liable for indirect or consequential loss, except where such exclusion is not permitted by law.
7. Website use
Content on this website (text, images, logos) is owned by or licensed to us and may not be copied or reused commercially without permission.
You must not misuse this website, attempt unauthorised access, or use it in breach of any applicable law.
8. Promotions and discount codes
Promotional offers are subject to their own Promotion Terms & Conditions. We may withdraw or vary a promotion at any time, except where doing so would affect rights you have already acquired.
9. Privacy
Any personal information you provide is handled in accordance with our Privacy Policy and the Privacy Act 2020.
10. General and governing law
If any provision of these terms is unenforceable, the remaining provisions continue in force.
These terms are governed by the laws of New Zealand, and the courts of New Zealand have non-exclusive jurisdiction.
